Terms and Conditions

INTRODUCTION

These Terms & Conditions (the “Terms”) govern the sale of products by House of Zadaz LLC operating under the brand ZADAZ (the “Company,” “we,” “us,” or “our”) through our website at www.houseofzadaz.com (the “Site”). The Terms are written to (i) explain how orders are formed, fulfilled, and—where applicable—returned or refunded, and (ii) allocate commercial and legal risk in a manner consistent with operating a premium direct-to-consumer footwear brand.

The Terms are intended to be read alongside our Return & Refund Policy and Privacy Policy/Cookie Policy. If there is a direct conflict between these Terms and an order-specific written agreement signed by the Company, the signed agreement controls for that order only.

1) DEFINITIONS AND INTERPRETATION

1.1 Definitions. In these Terms:
(a) “Business Day” means Monday through Friday excluding U.S. federal holidays.
(b) “Customer,” “you,” or “your” means any person who places an Order or otherwise purchases Products from the Company.
(c) “Delivery” means the point at which a carrier marks an Order as delivered to the shipping address provided by you, or otherwise makes the shipment available for delivery (including where delivery is refused or cannot be completed due to address issues).
(d) “Order” means a request submitted by you to purchase Products via the Site.
(e) “Original Condition” means the Product is unused and unworn and is returned with all original components (including the original box, inserts, tags where applicable) and without any damage, odor, scuffing, creasing, staining, sole wear, or other indications of use or handling inconsistent with in-home inspection.
(f) “Products” means the footwear and related physical goods offered for sale on the Site.
(g) “Return Authorization” means a return approval issued by the Company, which may include a return label and instructions.

1.2 Interpretation. Headings are for convenience and do not affect interpretation. “Including” means “including without limitation.” Any reference to “writing” includes email.

1.3 Commercial intent. These Terms allocate risk between the Company and Customer in a manner designed for consumer retail sales; pricing and remedies reflect that allocation.

2) ELIGIBILITY; PURCHASE FOR PERSONAL USE; MINIMUM AGE

2.1 Minimum age. You must be at least 13 years old to access the Site and at least 18 years old (or the age of legal majority in your jurisdiction) to place an Order. If you are not of legal purchasing age, a parent/guardian must place the Order and assumes responsibility for it.

2.2 Personal-use purchasing. Products are sold for personal use and gifting. The Company may limit, cancel, or refuse Orders that appear to be placed for resale, export brokerage, or other commercial redistribution, including where such activity could impair inventory availability or brand integrity.

2.3 Compliance with law. You are responsible for ensuring your purchase, importation, and use of Products complies with applicable laws in your jurisdiction (including customs/import rules for international Orders).

3) ACCOUNTS; GUEST CHECKOUT; ACCURACY OF INFORMATION

3.1 Account optional. You may checkout as a guest or create an account where enabled. You are responsible for maintaining the confidentiality of login credentials and for activity under your account.

3.2 Accurate information required. You must provide complete and accurate information (including name, email, phone number, and shipping address). The Company is not responsible for non-delivery, misdelivery, delays, or losses caused by incomplete or inaccurate information you provide.

3.3 Communications. By providing contact details, you authorize us (and our service providers) to contact you about your Order (e.g., confirmation, shipment updates, address verification, fraud checks, return instructions). Marketing communications are addressed under our Privacy Policy. Specifically, regarding SMS/text messaging: if you elect to receive marketing text messages, you agree to receive recurring automated marketing messages at the phone number provided. Consent is not a condition of purchase. Msg & data rates may apply.

4) SCOPE OF TERMS; UPDATES; ORDER-SPECIFIC TERMS

4.1 Scope. These Terms apply to browsing the Site and to all Orders unless we provide different terms for a particular Product, promotion, or Order.

4.2 Updates. We may update these Terms to reflect operational, legal, or risk changes. Updated Terms apply to future Orders from the effective date of the update. Orders are governed by the Terms in effect at the time you place the Order, unless a change is required by law or to address fraud/security concerns.

4.3 Supporting policies. Our return/refund practices are set out in our Return & Refund Policy; where these Terms summarize returns/refunds, the detailed process and conditions in the Return & Refund Policy apply.

5) PRODUCT AVAILABILITY; INVENTORY; QUANTITY LIMITS

5.1 Availability not guaranteed. Product listings are invitations to purchase and do not guarantee availability. Inventory may change rapidly and can be impacted by simultaneous purchases, quality control holds, or fulfillment constraints.

5.2 Order limits. We may limit quantities per customer, household, payment method, or shipping address, particularly for launches, limited editions, or suspected resale activity.

5.3 Discontinuation. We may discontinue Products or change specifications without notice. If a change materially affects a confirmed Order, we will provide a remedy consistent with these Terms (typically cancellation and refund).

6) Order Placement; Offer and Acceptance; Order Confirmation

6.1 Your offer. When you submit an Order, you are making an offer to buy the selected Products at the displayed price, subject to these Terms.

6.2 Acceptance. An automated confirmation email acknowledging receipt does not constitute acceptance. Acceptance occurs when we (a) confirm shipment of the Product(s), or (b) otherwise confirm acceptance in writing.

6.3 Refusal/cancellation before acceptance. We may refuse or cancel an Order prior to acceptance for reasons including: suspected fraud, payment authorization failure, inventory unavailability, shipping restrictions, or pricing/description errors.

6.4 Order records. We maintain transaction records for operational and legal purposes. Your bank/processor records may reflect authorizations or holds as described in Section 9.

7) Pricing; Promotions; Currency; Pricing Errors

7.1 Displayed pricing. Prices are displayed on the Site and are subject to change without notice. Price changes do not apply retroactively to accepted Orders.

7.2 Promotions and codes. Promotional offers, discount codes, and free-shipping offers may have conditions (eligibility, time limits, exclusions, single-use, non-transferability). Unless expressly stated, promotions cannot be combined.

7.3 Pricing and description errors. Despite reasonable controls, the Site may occasionally display incorrect pricing, typographical errors, or inaccurate information. If a Product is listed at an incorrect price or with materially incorrect information, we may (at our option) (a) cancel the Order and refund amounts paid, or (b) contact you with the correct information and provide the option to proceed or cancel. We are not obligated to honor pricing errors.

7.4 Currency. Unless the Site states otherwise, pricing is in U.S. Dollars (USD). Your bank may apply foreign exchange rates or fees.

8) Taxes, Duties, and Import Charges (Domestic + International)

8.1 Sales tax. Where required, we collect applicable sales tax based on your shipping address and the information available at checkout. Tax amounts may be estimates until your Order is processed.

8.2 International orders; duties and import fees. For Orders shipped outside the United States, you are responsible for all duties, import taxes, customs fees, brokerage fees, and any other governmental charges assessed by the destination jurisdiction, unless the Site expressly states such charges are included at checkout. Delays caused by customs clearance are outside our control. For clarity, all international Orders are shipped ‘Delivery Duty Unpaid’ (DDU), meaning you must pay all applicable duties and taxes to your local customs authority upon arrival to receive the package.”

8.3 Refused international shipments. If you refuse delivery or fail to pay required import charges and the shipment is returned or abandoned, we may treat the Order as ineligible for refund, or issue a partial refund net of shipping and return costs incurred, to the extent permitted by law (see also Sections 11–16).

9) Payment Methods; Authorization; Security; Declined Payments

9.1 Accepted payments. We accept major credit/debit cards (including Visa, Mastercard, American Express, Discover where enabled), PayPal, and may offer Apple Pay, Google Pay, and Shop Pay through Shopify (availability may vary).

9.2 No prohibited methods. We do not accept wire transfers, checks, or cash on delivery.

9.3 Authorization and holds. By submitting an Order, you authorize the Company (and our payment processors) to charge the payment method for the total amount (including taxes and shipping where applicable). Your issuer may place an authorization hold prior to capture/settlement. If an Order is canceled, your issuer determines when an authorization is released.

9.4 Payment security. Payment processing is handled through secure, industry-standard payment processors (e.g., Shopify Payments and PayPal). We do not store full payment card numbers on our servers; however, we may retain transaction identifiers and limited payment metadata for accounting, fraud prevention, and customer support.

9.5 Declined payments. If a payment is declined, reversed, disputed, or otherwise not received in full, we may (a) cancel the Order, (b) pause fulfillment/shipment, and/or (c) seek alternative payment. We are not responsible for bank/issuer decisions, including declines due to fraud controls.

10) Fraud Prevention; Screening; Identity Verification

10.1 Screening. We may use automated and manual fraud-prevention measures, including address verification, device and transaction risk scoring, and payment verification.

10.2 Verification requests. We may request additional information to verify identity or payment authorization (e.g., confirmation of billing details, proof of authorization). If verification is not provided within a reasonable timeframe, we may cancel the Order.

10.3 Protective cancellations. If we suspect unauthorized activity, resale schemes, chargeback risk, or other misuse, we may cancel Orders, refuse future Orders, and/or restrict account access. Where we cancel after payment capture, we will refund amounts received in accordance with these Terms.

11) Shipping; Handling Times; Delivery Estimates; Free Shipping

11.1 Free delivery. We offer free standard delivery as described at checkout for qualifying Orders. Free delivery does not mean expedited delivery, guaranteed delivery dates, or that returns are free unless expressly stated (see Sections 14–16).

11.2 Handling time. Orders are processed within our stated handling time at checkout (or, if not stated, within a commercially reasonable time). Handling time is separate from carrier transit time.

11.3 Delivery estimates. Any delivery estimates shown are non-binding estimates based on carrier data and operational experience. We are not liable for delays outside our reasonable control, including carrier delays, weather, customs, strikes, service interruptions, or incorrect address information.

11.4 Shipment tracking. Where available, tracking information is provided. Tracking events are controlled by the carrier; gaps or delays in tracking updates do not necessarily indicate loss.

11.5 Address changes. If you request an address change after placing an Order, we may not be able to accommodate it, especially once fulfillment begins. We are not responsible for delivery failures arising from late address change requests.

11.6 Split shipments. We may ship Products in multiple packages. Split shipment does not increase your cost unless stated.

12) Title, Risk of Loss, and Delivery Completion

12.1 Title transfer. Title to Products transfers to you upon our handoff of the Products to the carrier, to the extent permitted by applicable law.

12.2 Risk of loss. Risk of loss passes to you upon carrier handoff (or, where consumer law in your jurisdiction requires otherwise, at Delivery). If a package is marked delivered but not received, we may require cooperation with an investigation and may (at our discretion) offer a remedy consistent with carrier processes and fraud controls.

12.3 Delivery completion standard. Delivery is deemed complete when the carrier marks the package as delivered to the address provided. For multi-unit buildings, delivery to mailrooms, front desks, parcel lockers, or similar receiving areas constitutes Delivery.

12.4 Refused delivery / failed delivery. If a shipment is refused, returned to sender, or fails due to incorrect address details or inability to receive, we may treat the Order as a return not meeting return eligibility, and any refund may be reduced by our actual outbound and return shipping costs and handling costs, where permitted by law and consistent with Section 16.

13) Cancellations and Order Changes (24-hour rule; post-shipment)

13.1 Cancellation window (request-based). You may request cancellation within 24 hours of placing an Order by contacting us at support@houseofzadaz.com with your Order number. Because our fulfillment process may begin immediately, a cancellation request is not guaranteed unless we confirm it in writing.

13.2 No cancellation after shipment. Once an Order has been shipped (i.e., a carrier label is created and/or the package is tendered to the carrier), the Order cannot be cancelled. Your remedies, if any, are limited to the return/refund process set out in Sections 14–18.

13.3 Order changes. Requests to modify an Order (including size, color, address, or shipping method) must be made as soon as possible and are not guaranteed. If a requested change cannot be accommodated, you may request cancellation under Section 13.1 (subject to confirmation) or place a new Order.

13.4 Refusal of cancellation to prevent abuse. We may refuse repeated cancellation or change requests, or restrict accounts, where we reasonably believe the conduct is intended to game promotions, circumvent inventory limits, or increase fraud/chargeback risk.

14) Returns: Eligibility, Condition Standards, and “14-Day Right of Return”

14.1 14-day return period. Subject to these Terms, we accept return requests for eligible Products within 14 days of Delivery (the “Return Period”).

14.2 Eligibility requirements. A return is eligible only if:
(a) it is requested and shipped back within the Return Period (or as otherwise instructed in the Return Authorization);
(b) the Product is in Original Condition (as defined in Section 1.1); and
(c) it includes the original shoe box and any included materials.

14.3 What is not eligible. Returns are not eligible if the Product shows any signs of wear or use, including (without limitation): creasing of uppers, sole wear, scuffing, staining, odor, abrasion, or damage from improper handling, storage, or exposure to moisture/chemicals. For a premium leather shoe, even light outdoor wear typically renders the Product ineligible.

14.4 14-Day Right of Return (clarified). Any “14-day Right of Return” messaging means you may inspect the Product at home and request a return within the Return Period provided the Product remains in Original Condition. It does not create a right to wear the Product outdoors and then return it.

14.5 Return authorization required. Returns must be approved and issued a Return Authorization. We may refuse packages returned without authorization or outside the Return Period.

14.6 Condition verification. All returns are subject to inspection. If a returned Product does not meet eligibility conditions, we may (at our option):
(a) refuse the return and send the Product back to you (shipping payable by you), or
(b) accept the return with a reduced refund reflecting loss in value and processing costs to the extent permitted by law.

15) Return Shipping; Prepaid Labels; International Returns

15.1 Prepaid return label disclosure (U.S. domestic). For eligible U.S. domestic returns, we may provide a prepaid return shipping label as part of the Return Authorization.

15.2 Cost allocation (our error vs. discretionary returns).
(a) Defect/incorrect item/damage in transit. If the return is approved because we shipped the wrong item, the Product is defective upon arrival, or the Product was damaged in transit (subject to Section 17), we will provide a prepaid label and will not deduct return shipping from your refund.
(b) All other eligible returns (including satisfaction-based returns). For eligible returns that are not due to our error, we may provide a prepaid label and deduct the label cost from the refund (or, where offered, allow you to ship via your own trackable method). Any deduction (if applied) will be disclosed in the Return Authorization or return portal flow.

15.3 Packaging and responsibility. You are responsible for packaging returns securely. Damage occurring due to inadequate packaging may render the return ineligible or subject to reduced refund.

15.4 Trackable shipping required. If you choose your own carrier method, you must use a trackable service and retain proof of shipment. We are not responsible for loss or damage during return transit where you ship without tracking/insurance.

15.5 International returns. International customers are responsible for return shipping costs, customs paperwork, and any import/export fees unless the return is approved under Section 15.2(a) (our error), in which case we may (at our discretion) support return logistics. Duties/taxes paid to your country are generally non-refundable by us; you may seek recovery from your local customs authority where available.

16) Refunds: Timing, Method, Deductions, and Chargeback Handling

16.1 Refund method. Approved refunds are issued to the original payment method only. We do not provide cash refunds, wire refunds, or refunds to alternative accounts.

16.2 Refund timing. Once your return is received and inspected, we typically process approved refunds within 5–7 Business Days. Your bank/payment provider may take additional time to post the credit.

16.3 Refund amount and deductions.
(a) Shipping. Outbound shipping is free as a promotional commercial term and is not a separate purchased service unless stated otherwise. Where permitted by law, if a return is not due to our error, we may deduct return label costs as set out in Section 15.2(b).
(b) Reduced refund for nonconforming returns. If we accept a nonconforming return under Section 14.6(b), the refund may be reduced to reflect diminished value, repackaging, and administrative handling, to the extent permitted by law.
(c) Fees imposed by processors. We do not deduct ordinary payment processing fees from refunds where prohibited or commercially unreasonable; however, where a processor imposes non-recoverable fees due to a payment dispute initiated by you, we reserve rights under Section 16.6.

16.4 No refund for ineligible returns. If the return is rejected, no refund will be issued and we may return the Product to you at your cost (or, if you do not respond within a reasonable time, treat the Product as abandoned to the extent permitted by law).

16.5 Partial refunds. If an Order included multiple items, refunds may be itemized and processed per item as returns are received and inspected.

16.6 Chargebacks and payment disputes. If you initiate a chargeback or payment dispute for an Order, we may suspend processing of any return/refund until the dispute is resolved. If a chargeback is granted after we have shipped and/or after we have issued a refund, you agree we may (where lawful) pursue recovery of amounts owed and any documented third-party fees arising from the dispute, and we may restrict future purchases.

17) Incorrect, Damaged, or Defective Products; Remedies

17.1 Notification requirement. If your Order arrives incorrect, damaged, or materially defective, you must notify us within 7 days of Delivery at support@houseofzadaz.com and include: (a) your Order number, and (b) clear photographs of the Product and packaging.

17.2 Carrier damage and packaging evidence. For damage in transit, we may require photographs of the shipping box and labels to support a carrier claim. Failure to preserve packaging or provide reasonable evidence may limit remedies.

17.3 Defect standard. “Defective” means a material manufacturing fault present upon arrival or emerging with normal, intended wear within a reasonable period—excluding normal wear and tear, misuse, improper storage, exposure to water/chemicals, alterations/repairs by third parties, or sizing/fit preference.

17.4 Remedies. Where a claim is verified, our remedies may include (at our option and subject to applicable law):
(a) replacement of the Product (if available),
(b) repair (where commercially reasonable), or
(c) refund (full or partial as appropriate).
We may require return of the Product before issuing a remedy.

17.5 Legal rights preserved. Nothing in this Section limits rights you may have under applicable consumer protection or warranty laws that cannot be excluded.

18) No Exchanges; Replacement Process; Limited Exceptions

18.1 No exchanges policy. We do not offer exchanges. If you need a different size or style, you must return the eligible Product under Sections 14–16 and place a new Order.

18.2 Replacements for verified issues. Replacements may be offered only in cases of verified defect, damage, or incorrect item shipment, and are subject to inventory availability. If a replacement is not available, the remedy will be a refund (or other lawful remedy) under Section 17.

18.3 Price changes and promotions. If you return and repurchase, the new Order will be priced under the terms and promotions in effect at the time of repurchase. We do not guarantee price matching.

19) Product Characteristics; Handcrafted Variation; Color/Material Disclaimers

19.1 Handcrafted variation. Our Products are handcrafted and may exhibit natural variations in leather grain, tone, texture, stitching, and finishing. Such variations are inherent characteristics of premium materials and craftsmanship and are not defects.

19.2 Color accuracy. Product images are intended to represent Products as accurately as reasonably possible, but display settings, lighting, and device calibration may affect color perception. Minor variations between photographs and delivered Products do not constitute nonconformity.

19.3 Leather and material care. Leather is sensitive to moisture, abrasion, heat, and chemicals. You are responsible for reasonable care and maintenance. Damage resulting from improper care, exposure, or misuse is not covered as a defect.

19.4 Sizing, Fit, and Comfort. Fit can vary by style and foot shape. Any sizing guidance is informational and not a guarantee. Leather footwear often requires a ‘break-in’ period to conform to your foot; stiffness, tightness, or minor squeaking during this period are normal characteristics of high-quality leather construction and are not defects. Fit preference or subjective comfort issues alone do not constitute a material defect.

19.5 California Proposition 65. To comply with California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (“Proposition 65”), we provide the following warning to California consumers: We are committed to compliance with California Proposition 65. Our products are made from high-quality materials; however, if a Product contains chemicals known to the State of California to cause cancer and birth defects or other reproductive harm, we will provide the required warning on the Product’s packaging or description page.

WARNING: Products sold on this Site may contain chemicals (such as chromium used in leather tanning processes) known to the State of California to cause cancer, birth defects, or other reproductive harm. Where required by law, a specific warning label is provided on the Product packaging and/or the Product description page. For more information, please visit www.P65Warnings.ca.gov.

20) Intellectual Property; Site Content; Brand Assets

20.1 Ownership. The Site and all content (including text, photographs, product images, graphics, logos, trademarks, trade dress, designs, and software) are owned by or licensed to the Company and are protected by U.S. and international intellectual property laws.

20.2 Limited license. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial shopping purposes only.

20.3 Restrictions. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, scrape, data-mine, reverse engineer, or exploit any portion of the Site or content without our prior written consent.

20.4 Trademark use. “ZADAZ,” “House of Zadaz,” and associated marks may not be used in any manner likely to cause confusion, dilution, or unfair association.

21) Reviews, Submissions, and User Content; License; Moderation

21.1 User content. If you submit reviews, comments, photos, videos, or other content (collectively, “User Content”), you represent that: (a) you own it or have rights to submit it, (b) it is accurate, non-defamatory, non-infringing, and lawful, and (c) it does not include confidential or sensitive personal information of others.

21.2 License to the Company. You grant the Company a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, display, distribute, adapt, translate, and create derivative works of your User Content for marketing, product, and Site operation purposes, without compensation to you, subject to applicable law.

21.3 No obligation to publish. We are not required to publish User Content and may remove or moderate content at our discretion, including for suspected fraud, offensive content, or policy violations.

21.4 Attribution. User Content may be displayed with your first name/initials, city/state, or other non-sensitive attribution as part of Site functionality.

21.5 Copyright Infringement (DMCA). We respect intellectual property rights. If you believe your work has been copied in a way that constitutes copyright infringement by any content on the Site, please submit a notice to our designated agent at support@houseofzadaz.com containing the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512), including a description of the copyrighted work and the location of the infringing material.

22) Prohibited Conduct; Site Integrity; Automated Access

22.1 Prohibited conduct. You agree not to:
(a) violate any law or regulation;
(b) interfere with Site security or operations;
(c) use bots, scrapers, or automated tools to access the Site;
(d) attempt to gain unauthorized access to accounts, systems, or networks;
(e) submit false information, impersonate others, or engage in payment fraud;
(f) engage in abusive conduct toward our staff or service providers; or
(g) use the Site for resale schemes or to circumvent purchase limits.

22.2 Enforcement. We may suspend or terminate access, cancel Orders, refuse service, and/or take legal action where we reasonably believe prohibited conduct has occurred.

23) Disclaimers; Limitation of Liability; Indemnity

23.1 No medical or specialist advice. The Site does not provide medical, podiatric, or other professional advice. Any comfort, performance, or durability statements are general product descriptions and not individualized advice.

23.2 Disclaimers (to the maximum extent permitted). Except as expressly stated in writing by the Company and to the maximum extent permitted by law, the Site and Products are provided “as is” and “as available,” and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain warranty disclaimers; in those jurisdictions, disclaimers apply only to the maximum extent permitted.

23.3 Limitation of liability. To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages (including lost profits, lost data, or business interruption) arising out of or related to the Site, Products, or these Terms, even if advised of the possibility.

23.4 Liability cap. To the maximum extent permitted by law, the Company’s total liability for any claim arising out of or related to an Order will not exceed the amount you paid for the Product(s) giving rise to the claim.

23.5 Essential basis. You acknowledge that the limitations in this Section are a fundamental allocation of risk and form an essential basis of the bargain between you and the Company.

23.6 Indemnity. You agree to indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms, (b) your misuse of the Site, (c) your User Content, or (d) your violation of law or third-party rights.

24) Dispute Resolution; Venue; Arbitration and Class Action Waiver

24.1 Governing law. These Terms and any dispute arising out of or related to the Site or Products are governed by the laws of the State of California, without regard to conflict-of-law rules, except where preempted by federal law (including the Federal Arbitration Act).

24.2 Informal resolution first. Before filing a claim, you agree to contact us at support@houseofzadaz.com and provide: your name, Order number (if applicable), a description of the issue, and the relief sought. The parties will attempt in good faith to resolve the dispute within 14 days.

24.3 Binding arbitration (individual). Except for disputes eligible for small claims court that are brought in San Diego, California, and requests injunctive relief relating to intellectual property or unauthorized access, any dispute arising out of or related to these Terms, the Site, or Products will be resolved by binding, individual arbitration administered by AAA or JAMS (Company election), under the applicable consumer arbitration rules.

24.4 Arbitration location and procedure. Unless you and the Company agree otherwise, arbitration will take place in San Diego County, California, though the arbitrator may permit remote proceedings. The arbitrator may award any relief that a court could award, consistent with applicable law and these Terms.

24.5 Costs. Consumer filing fees will be handled in accordance with the administrator’s consumer rules. Where required by those rules or applicable law, the Company will pay its share and/or the bulk of arbitration fees. Each party bears its own attorneys’ fees unless a statute provides otherwise.

24.6 Class action waiver. You and the Company agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding, to the maximum extent permitted by law.

24.7 Opt-out right. You may opt out of arbitration and the class action waiver by sending written notice to support@houseofzadaz.com within 14 days of first accepting these Terms. Your notice must include your name, address, email, and a clear statement that you wish to opt out. Opting out will not affect any other provisions.

24.8 Severability of dispute terms. If any portion of this Section is found unenforceable, the remaining portions remain in effect, except that if the class action waiver is found unenforceable, the arbitration requirement may be severed to the extent required by law.

25) Miscellaneous: Severability, Assignment, Force Majeure, Notices

25.1 Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.

25.2 Assignment. You may not assign or transfer these Terms or your rights/obligations without our prior written consent. We may assign these Terms (including in connection with a merger, acquisition, or sale of assets).

25.3 Force majeure. We are not liable for failure or delay in performance caused by events beyond our reasonable control, including carrier disruption, customs delays, labor disputes, supply interruption, acts of government, natural disasters, war, terrorism, epidemics/pandemics, or internet/service outages.

25.4 No waiver. Failure to enforce any provision is not a waiver of future enforcement of that provision or any other provision.

25.5 Entire agreement. These Terms, together with any policies expressly incorporated by reference (including the Return & Refund Policy), constitute the entire agreement between you and the Company regarding the Site and Orders, superseding prior or contemporaneous communications on the subject.

25.6 Notices.
(a) To you: we may provide notices via email, your account (if applicable), or posting on the Site.
(b) To us: notices must be sent to clientcare@houseofzadaz.com (email) and, if required, to the business address listed above.

25.7 Contact. Customer support inquiries should be directed to clientcare@houseofzadaz.com.

25.8 Web Accessibility Statement. The Company is committed to providing a website that is accessible to the widest possible audience, regardless of technology or ability. We aim to comply with all applicable standards, including WCAG 2.1 accessibility standards up to level AA. If you experience any difficulty in accessing any part of the Site, please contact us at support@houseofzadaz.com, and we will work with you to provide the information, item, or transaction you seek through a communication method that is accessible for you consistent with applicable law (for example, through telephone support).
